The Probate Administration Process in Florida
- Step 1: Filing the Petition — We prepare and file the Petition for Administration with the Broward County Circuit Court, along with the original will (if one exists) and supporting documents.
- Step 2: Appointment of Personal Representative — The court appoints a personal representative (executor) and issues Letters of Administration, giving legal authority to manage the estate.
- Step 3: Inventory of Assets — We identify, locate, and value all probate assets, then file a detailed inventory with the court within the required timeframe.
- Step 4: Notifying Creditors — We publish the required notice to creditors and notify known creditors so valid debts can be paid from estate assets.
- Step 5: Paying Debts, Taxes & Expenses — We handle payment of the decedent’s final debts, funeral expenses, and any applicable taxes (including estate tax returns when required).
- Step 6: Distributing Assets — Once all obligations are met, we distribute the remaining assets to the beneficiaries named in the will or according to Florida intestacy laws.
- Step 7: Closing the Estate — We prepare the final accounting and petition the court for discharge of the personal representative, officially closing the probate case.
